marktumfrage.ch offers AI-powered online analyses: Website Analysis, Instagram Analysis, YouTube Analysis, and Market Analysis. Results are delivered as a action plan via email. The analyses are generated automatically using artificial intelligence and serve as guidance. They do not replace professional consulting and do not guarantee business success.

3. Contract Formation

A contract is formed when you complete the analysis form on the website, select the desired analysis, and successfully complete payment through the payment service provider Stripe. The electronic confirmation email serves as order confirmation.

4. Prices and Payment

Prices depend on the selected analysis type and are displayed transparently before payment. All prices are final; no VAT is charged (sole proprietorship exempt from VAT). Payment is processed exclusively through the payment service provider Stripe (credit card, TWINT, Apple Pay). By paying, you also accept Stripe's terms of service (stripe.com/legal).

5. Delivery

The action plan is automatically generated after successful payment and sent to the email address you provided. Delivery typically takes a few hours but may take up to 24 hours depending on demand.

6. Right of Withdrawal

Under Swiss law, there is no statutory right of withdrawal for online purchases. As our analyses are digital services that are created and delivered immediately after payment, withdrawal or refund after payment is excluded. By completing payment, you expressly agree that the service will be provided immediately and that no claim for refund of the amount paid exists. This exclusion applies regardless of whether the report has already been delivered. No legal claim for reimbursement can be asserted. No warranty is given for the completeness, accuracy, timeliness, or suitability for a particular purpose. Analyses serve exclusively as an informative decision-making basis and do not replace professional advice from qualified experts (e.g., marketing consultants, SEO specialists, legal advisors). The customer is advised to independently verify results before implementation.

8. Limitation of Liability

The liability of marktumfrage.ch is limited to the amount paid by the customer. Any liability for indirect damages, lost profits, data loss, reputational damages, or consequential damages — in particular those arising from the implementation of AI-generated recommendations — is excluded to the extent permitted by law. marktumfrage.ch shall not be liable for decisions made on the basis of the AI analysis.
